It often starts innocently, with a couple of drinks after work or a late dinner with friends. You feel fine, maybe even confident behind the wheel, until flashing lights suddenly appear in your rearview mirror.
What follows isn’t just a ticket or a warning. In British Columbia, impaired driving laws are strict, fast-moving, and often unforgiving. And if you’re on the receiving end of them, the experience can feel less like a process and more like a landslide.
This is where understanding your rights and speaking to a criminal defence lawyer becomes less of an option and more of a necessity.
The Reality of Impaired Driving Laws in B.C.
British Columbia operates under a dual system when it comes to impaired driving: you face administrative action with RoadSafetyBC, and may also face criminal charges under the Criminal Code of Canada.
The administrative action takes the form of an immediate driving prohibition. Police may administer a breath test roadside and if you fail it or refuse to provide a sample you are prohibited from driving for 90 days. At the expiration of that 90-day period you are required to enroll and pay for the Responsible Driver Program. There are additional financial penalties and, depending on your driving history, you could face a longer driving suspension and/or be required to install an Ignition Interlock in any vehicle you wish to drive after the suspension.
If you wish to challenge the 90-day driving prohibition, time is of the essence. You have seven days to file a challenge and, if you miss that, you may not be able to get an extension.
If you are charged criminally as well, a conviction results in at least a sizeable fine, a one-year driving prohibition, and a criminal record. There are other penalties as well, such as 10 points on your licence and other financial consequences with ICBC. If you were involved in an accident, a criminal conviction for impaired/over 80 voids your insurance coverage so you would be personally responsible for any damages. The law in this area continues to change and evolve, so these are just some of the consequencs that can flow (i.e. this is not an exhaustive list).
If police proceed criminally they will typically arrest you and take you back to the police station to undergo more comprehensive testing. Police will typically release you from the police station once they are satisfied it is safe to do so. Upon released you will be given an initial court date. The police may also attach conditions to your release (aka bail conditions) and those can be onerous. If they do, application may be made to the court to have them varied.
In summary, an impaired case typically starts with police requiring you to provide a sample of your breath. If you fail to do so, or blow a “fail”, you will be given a 90-day driving prohibition. You may also face criminal charges. It is important to receive timely legal advice from a lawyer experienced in handling impaired driving cases.
“Over the Limit” Isn’t Always So Clear
Breath readings that exceed the legal limit (over 08) are not necessarily definitive proof you were over 08 at the time of driving. Breathalyzer readings are not infallible. They depend on proper calibration, correct administration, and strict adherence to procedure.
If any of those elements are off, the reliability of the result can be challenged.
A seasoned defence lawyer doesn’t just look at the number. They look at how that number was obtained.
A Case That Didn’t Go the Way You’d Expect
Consider this scenario: a driver is pulled over at a routine check stop, cooperates fully, and provides a breath sample, only to have the result come back as a “fail.” From the outside, it may seem like an open-and-shut case.
But upon review, the defence discovers the officer did not comply with the requirement that a person be provided the opportunity to provide a second sample on a different machine. That is a requirement under the Motor Vehicle Act and exists for a reason. The approved screening devices administered roadside are not infallible, and a second test that does not produce a fail result would be the one that would prevail. In such a case, the 90-day prohibition should be overturned.
With respect to the accompanying criminal prosecution, a failure on the part of the police to administer testing in a timely manner may result in evidence of the breath samples being excluded. A violation of one’s Charter rights may also result in the exclusion of evidence the state would otherwise rely on in support of their case.
In the above scenario, the driver is successful not because they argued they were not drinking, but because the process didn’t meet the legal standard required to justify the penalty or a criminal conviction.
This is the part many people miss. The system has rules. When those rules aren’t followed, outcomes can change.
Why Timing Matters More Than You Think
If you receive a 90-day driving prohibition in British Columbia, you have a limited window to act. You have seven days to file for a review. Miss that window, and your ability to challenge the prohibition may be barred. It is important not to leave it to the last minute to consult with counsel.
A criminal defence lawyer can step in immediately, request disclosure, and begin building a case for review. That early involvement often makes the difference between a successful challenge and a missed opportunity.
The Cost Goes Beyond Fines
People tend to focus on the immediate penalties, the fine, the licence suspension, and the inconvenience.
But the longer-term consequences are where impaired driving really leaves its mark.
- Insurance premiums can increase significantly
- Employment can be affected, especially if driving is part of your job
- Travel, particularly to the United States, can become complicated with a criminal conviction
Even a non-criminal administrative penalty can create ripple effects that last far longer than the initial prohibition.
This is why a strategic approach matters. Not every case is about going to trial. Sometimes it’s about minimizing long-term damage.
What a Defence Lawyer Actually Does in These Cases
There’s a misconception that hiring a lawyer is about “getting off on a technicality.” This is not a fair characterization. Process and procedures are there for good reason. It’s about ensuring the system operates fairly for an accused. That your rights are respected. That evidence is reliable. That decisions are made based on proper procedure, not assumptions.
A defence lawyer will typically:
- Review the circumstances of the stop and detention
- Examine how and when the breath demand was made
- Analyze whether testing procedures were followed correctly
- Identify any Charter violations or procedural errors
- Represent you in a review of a 90-day prohibition or criminal court proceeding
It’s detailed work, which often takes place behind the scenes. But it’s where cases are won or lost.
The Instinct to Explain Can Work Against You
After being pulled over, many people try to talk their way through the situation. They explain how much they drank, when they last had a drink, how they feel.
Statements made in those moments can be used later in ways you didn’t anticipate. What feels like harmless context can become evidence.
If you are arrested, exercising your right to speak with a lawyer before making statements isn’t about being difficult. It’s about being careful.
The Takeaway: Don’t Treat It Casually
Driving while intoxicated in British Columbia is treated seriously by design. The laws are structured to deter, to act quickly, and to impose meaningful consequences. But serious enforcement doesn’t eliminate the possibility of error.
If you’re facing an impaired driving allegation or a 90-day driving prohibtion, the worst move is to assume there’s nothing you can do. There often is.
The key is acting quickly, understanding your options, and getting the right guidance early. An experienced criminal defence lawyer can help you navigate the process, challenge what needs to be challenged, and protect what matters most moving forward.
Once the system is in motion, standing still is rarely your best strategy.
